Distance Sales Agreement

Buyer: The consumer making a reservation through the website.
2. Subject
The subject of this Agreement is the sale and performance of the boat tour / Bosphorus tour / dinner tour service, which the Buyer orders electronically through the website named lufertour.com (“Site”), and the determination of the rights and obligations of the parties pursuant to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
3. Nature and Price of the Service
The subject service is determined according to the tour, date, time, number of persons, and options selected on the Site. The basic characteristics of the service (departure pier, duration, included/excluded items, child policy) are provided on the relevant product page on the Site and in the order summary. The total price includes VAT and is clearly shown during checkout and in the order confirmation email.
4. Payment
Payments are made via the PCI-DSS certified payment provider Iyzico through 3D Secure infrastructure. Lufer Tour does not store card information on its servers. The order becomes valid after payment confirmation.
5. Performance Period and Place
The service shall be performed on the date and time selected by the Buyer, at the departure pier specified on the relevant product page. The Seller reserves the right to change the departure pier and/or time, or postpone/cancel the tour due to adverse weather conditions, maritime safety, or force majeure; in such cases, an alternative date or a full refund shall be offered to the Buyer.
6. Right of Withdrawal (IMPORTANT)
Since the subject of this Agreement is a leisure and recreational service provided on a specific date and at a specific time, the Buyer does not have a 14-day right of withdrawal pursuant to Article 15/g of the Regulation on Distance Contracts. The Buyer expressly acknowledges this during payment by declaring it in the Pre-Information Form.
7. Cancellation and Refund Policy
- For cancellation requests made 24 hours or more before the tour time: 100% of the paid amount will be refunded to the Buyer. The refund will be processed through Iyzico to the payment method used within 7-14 business days.
- For cancellations made less than 24 hours before the tour time, no-show, or late arrival: no refund will be made to the Buyer. The service shall be deemed performed.
- For cancellations due to adverse weather / Coast Guard decision / force majeure attributable to the Seller: the Buyer is entitled to an alternative date or a 100% refund.
- In case of operational necessity, pier/time changes: the Buyer will be notified at least 6 hours in advance via email/SMS; the Buyer may either join the new program under the same conditions or receive a 100% refund.
Refund requests may be submitted via the “My Reservations → Refund Request” menu on the Site or by emailing bilgi@lufer.com.tr.
8. General Provisions
- The Buyer undertakes that participants under the age of 18 will be accompanied by a parent/guardian and that all necessary disclosures regarding health conditions have been made.
- Passengers found to be under the influence of alcohol/drugs on the boat may be removed from the tour by the captain; in such cases, no refund will be made.
- The email address provided by the Buyer through the contact form shall be deemed a valid notification address.
- In case of disputes, the Istanbul (Anatolian Side) Consumer Arbitration Committees and Consumer Courts shall have jurisdiction.
